Governor Sarah Huckabee Sanders declares state of emergency in response to severe thunderstorms in Northwest Arkansas

Little Rock, Arkansas – On August 17, 2024, Arkansas Governor Sarah Huckabee Sanders officially declared a state of emergency in response to the severe thunderstorms and strong winds that swept through Northwest Arkansas on or about August 16, 2024. The extreme weather event caused significant damage, including numerous downed power lines, which have left many Arkansas residents without electricity and created dangerous conditions across the region.

Severe Weather Causes Widespread Damage

The storms that hit the area on August 16 brought strong winds and heavy rain, leading to widespread power outages and hazardous conditions. The damage included numerous downed power lines, which are complicating efforts to restore electricity to affected areas. These downed lines have made it necessary for commercial vehicles to transport heavy equipment, such as oversized loads, transformers, and other critical hardware, to assist line crews working tirelessly to restore power.

Emergency Measures to Expedite Relief Efforts

In response to the damage and ongoing threat to public safety, Governor Sanders issued an emergency declaration, officially known as DR 24-06. The declaration is intended to expedite the restoration of power and ensure the safety of both workers and residents.

Governor Sanders emphasized the importance of maintaining a safe distance from downed power lines and the equipment used by line crews. To facilitate the rapid deployment of resources and personnel needed to restore power, the Governor invoked emergency executive powers to suspend certain regulatory statutes. This allows for a more efficient response by state agencies and commercial carriers involved in the relief efforts.

Temporary Exemptions for Emergency Relief Operations

Under the emergency declaration, commercial vehicles hauling heavy equipment, oversized loads, and other essential transmission and distribution equipment are temporarily exempt from certain federal regulations. Specifically, motor carriers and drivers operating these commercial vehicles to provide emergency relief are exempt from federal regulations governing maximum drive time for a period not to exceed 14 days, as permitted by 49 CFR §390.23.

Furthermore, emergency response vehicles, including utility vehicles, bucket trucks, and electric utility supply trucks actively responding to the storm-related damage, are authorized to bypass all Arkansas Department of Transportation weigh station facilities through August 31, 2024. However, this authorization does not apply to vehicles that require special permits to operate on Arkansas roadways and does not relieve vehicles of size and weight restrictions.

Coordinated Statewide Response

In addition to these measures, Governor Sanders has suspended all provisions of regulating statutes that could hinder or delay the response efforts of state departments and agencies. This includes the Office of State Procurement, the Arkansas Building Authority, and the Office of Personnel Management. The goal is to ensure that the Arkansas Department of Energy and Environment, along with the Arkansas Department of Public Safety, can work efficiently and effectively through the Arkansas Division of Emergency Management to provide the necessary support to affected communities.

Governor Sanders’ swift action underscores the seriousness of the situation and the state’s commitment to restoring normalcy as quickly as possible. As work continues to repair the damage and restore power, the emergency declaration will remain in effect, providing the necessary legal framework to support these efforts.

The state government urges residents to remain vigilant and follow safety guidelines, especially when near downed power lines or when encountering line crews working in the area. With the emergency measures in place, the state of Arkansas is poised to address the challenges posed by this severe weather event and ensure the safety and well-being of its citizens.

This declaration marks another significant effort by Governor Sanders to respond proactively to natural disasters, prioritizing the health and safety of Arkansas residents in times of crisis.
